Updated August 2026. Special rules have applied to the offer and supply of biocidal antifoulings in Germany since 1 January 2025. They are set out in the German Biocidal Products Implementation Ordinance (ChemBiozidDV) and are intended to ensure that buyers receive information about proper use, risks, protective measures, storage and disposal.
Which antifoulings are affected?
Biocidal antifouling products belong to product type 21. Section 10 prohibits self-service: customers in physical stores must not have unrestricted access to these products. A biocide-free underwater coating does not fall into this product type merely because it is used on a boat. The classification and label of the specific product are decisive.
What must be clarified before supply?
The product is supplied by a suitably qualified person. Before purchase, the intended user category and proper use are checked. The required consultation covers:
- preventive measures and lower-risk alternatives,
- proper use, including prohibitions and restrictions,
- risks and risk-reduction measures,
- precautions and action in the event of a spill or release,
- proper storage and disposal.
A sailing or boating licence is not a general statutory proof of eligibility. The permitted user category, intended use and requirements for the individual product are what matter.
What applies to online sales?
Under section 12, online and distance sales require a documented telephone or video consultation with a qualified person before the purchase contract is concluded. An automated notice or checkbox does not replace this conversation.

What does this mean for product selection?
